Bondsmen Help Protect the Rights of Citizens

Bail bondsmen uphold the law, and by doing so, they provide to their clients adequate means of getting out of jail while awaiting court proceedings. According to American principles, a person is innocent until proven guilty, even though this is forgotten at times. This rule of the legal system is very much apparent through the bail bond system. When someone is arrested, whether guilty or innocent, using a bail bondsman allows the defendant to carry on with life and prepare a good defense while they are awaiting their trial date.

In different ways, a bail bondsman serves a purpose on both the defendant's side as well as the courts side. As bonds aren't allowed for every crime or suspect, the legal system upholds the law by protecting all citizens. The main objective of the court is to make sure it is safe to let a defendant out of jail. The court is equally concerned with how probable it is for the defendant to commit another or more severe crime. A bail amount is set (or denied) accordingly.

A bail bondsman specifically knows the bail bonds system.  Bondsmen are to be professional and fully understand the importance of laws related to bail. If and when a court allows a bail to be posted, a bondsman's role is to ensure that the defendant will show up to any hearings pertaining to that specific case.

In the state of California, the bail bond fee is set at 10% of the overall bail. The bondsman is paid the fee for accepting responsibility to be sure the defendant shows up for court. A bail bondsman has the right to revoke a bond if the defendant shows signs of not being committed.

However, bail does not require a bail bondsman.  Sometimes cash bonds can be done by the defendant. For many people, this can be a difficult task as much of their money may be tied up with other legal fees. In some cases, the court may accept a property bond which means that a property will be signed over to the court to guarantee the defendant will show up to court dates in the future. Property bonds are rare because they take 60 to 90 days to complete and the property must have equity equaling at least 150% of the bail amount.

Bail bondsmen provide help with bail bonds. A surety bond is a bond that is backed by an outside source, instead of cash, and can be used on misdemeanor and felony bonds.

Bail bondsmen represent a part of the legal system that is fair and strong. They help defendants to be able to carry on with their life and prepare great defense cases, verses sitting in jail awaiting trial. They provide services to both sides of the legal line, the court and the defendant.
